Terms of Service
Last updated: July 21, 2026These terms govern your use of the BrightStart app and the www.brightstart.zenerly.com website, published by Zenerly. By downloading, installing, or using BrightStart, a parent or guardian agrees to these terms on behalf of themselves and any child who plays.
01 Acceptance of Terms
By downloading, installing, accessing, or using BrightStart (the "App") or the BrightStart website (together, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. Because BrightStart is designed for children, we expect a parent or guardian to review these Terms and to supervise their child's use of the App.
02 Description of the Service
BrightStart is a career-adventure learning game for kids ages 3–18. Players explore career "worlds" (Doctor, Engineer, Scientist, Pilot and others) and complete short missions that teach real subjects such as Math, English, Geography and Science. The App does not require an account, works offline for gameplay, and currently has no in-app purchases and no advertising.
03 Eligibility & Parental Consent
BrightStart is intended for use by children under the supervision of a parent or guardian who controls the device it's installed on. By setting up a player profile, you represent that you are a parent or guardian (or otherwise have legal authority) consenting to your child's use of the App, and that any information entered (such as a display name or age band) is accurate to the extent needed to tailor mission difficulty.

04 License to Use the App
Subject to these Terms, Zenerly grants you a limited, non-exclusive, non-transferable, revocable license to install and use BrightStart on devices you own or control, for personal, non-commercial, family use. This license does not give you any ownership interest in the App, its code, art, or content.
You may not: reverse-engineer, decompile, or extract the App's source code except as permitted by law; resell, sublicense, or redistribute the App; use the App to build a competing product; or remove or alter any proprietary notices.
05 Acceptable Use
BrightStart has no chat, no user-generated content, and no way for players to interact with each other, so most "acceptable use" concerns simply don't apply. On the website's Early Access and Contact forms, you agree not to submit false information, attempt to abuse or overload the forms (for example, automated spam submissions), or submit content that is unlawful, harassing, or infringes on someone else's rights.
06 Content & Intellectual Property
All content in BrightStart — including the career-world designs, mission questions, artwork, badges, the BrightStart name and logo, and underlying software — is owned by Zenerly or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any of that ownership to you. A child's in-app progress (XP, badges, streaks) exists only as data on their device and is not a purchasable or transferable asset.
07 Purchases & Advertising
In-app purchases: BrightStart currently has no in-app purchases. If purchasable content is introduced in a future release, these Terms will be updated, purchases will be processed through the applicable app store's official payment system (Google Play Billing / Apple's In-App Purchase), and pricing will be disclosed before any purchase is made.
Advertising: BrightStart currently shows no ads. If advertising (via Google AdMob) is introduced in a future release, it will follow the commitments described in the Advertising & AdMob section of our Privacy Policy, including non-personalized ads for child-directed sessions.
08 Third-Party Services
The Service relies on third-party platforms — Google Play and/or the Apple App Store for distribution, and Firebase for optional analytics. Your use of those platforms is also governed by their own terms and privacy policies. We are not responsible for the availability, content, or practices of third-party platforms beyond BrightStart's own integration with them.
09 Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular educational outcome will result from using BrightStart. BrightStart is a supplement to, not a replacement for, formal education.
10 Limitation of Liability
To the maximum extent permitted by law, Zenerly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service. Because BrightStart stores gameplay data locally on-device, we are not able to recover progress lost due to app uninstalls, device resets, or storage clearing — please keep this in mind if that matters to your family.
11 Termination
You may stop using the Service at any time by uninstalling the App. We may suspend or discontinue any part of the Service (for example, the website's forms or optional analytics) at our discretion, with or without notice, particularly to address abuse, legal requirements, or technical necessity.
12 Changes to These Terms
We may update these Terms as the Service evolves — for example, before introducing purchases or advertising. Material changes will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13 Governing Law
These Terms are governed by the laws applicable to Zenerly's place of business, without regard to conflict-of-law principles, except where local consumer-protection law provides otherwise for users in their home jurisdiction.
